"You" (or any variation thereof), the Client, shall mean any natural or legal person who has agreed to avail the services of HealthyG1 through any of its practitioners and/or partners and/or associates and/or affiliates and/or service providers at any of its locations.

These are the Terms and Conditions which apply to your use of our service and the Website. Please read them carefully. By proceeding with access to our services and the Website, you are deemed to have accepted these terms and conditions. We reserve the right to vary the conditions of use at any time and will post any variations on the Website.

1. About Us

We are HealthyG1. We offer Effective AYUSH HealthCare & Advanced Homeopathic Treatments via Health Tourism Services in Karjat at the foothills of Bhimashankar. This is a unique Health Tourism service which offers you an opportunity to undergo Medical Screening for Hereditary Diseases and Discover Health Full of Life thus Nurturing Healthy Human Lineage. We offer completely unbiased Medical Screening service as we have no affiliation with the HealthCare providers on our panel.  They aren't owned by us (nor us by them), nor do we have any voting rights or financial investments with them.

HealthyG1 is a “Health Tourism” services provider & the booking for such services is available on www.booking.com and other such websites. “Medical Screening” services are available through our website and other medical services provider websites.

2. Our Service To You
We are an online-only “Health Tourism” services provider website.  We work hard to ensure that we have a wide selection of products for you to research and select.

We can’t offer you advice or make a recommendation on what service is right for you, but we do try and give you all the information you need to help you decide.

3. How Our Service Works
You will be asked to answer a few questions on our Website. These questions are designed to ensure that we, and the healthcare service providers on our panel, have all the information necessary to provide you with products that meet your criteria. We cannot guarantee a quote for every circumstance.

It is your responsibility to ensure the information you submit is true, complete, accurate and not misleading. Failing to do so could invalidate your result.

We will send you an email detailing your results. The email will be sent to the email address you provide when submitting your details to obtain a quote on our website.

We accept no responsibility for any change in price or cover levels made by HealthCare service providers. It is your responsibility to check that the quotes are valid at the time of arranging medical treatments.

Please be aware, that whilst we provide information on a wide range of HealthCare products or services, there may be other products or services available in the market that are not shown on our website and which may be more appropriate or suitable for you.

4. Payment
Full payment for products referred to on this website is required at the time of booking a program / schedule. To make a payment, you will be offered a QR code which you need to scan and complete the payment. You are required to produce proof of payment whenever requested by any of our service providers. We do not store payment details. We accept payment via all major credit/debit cards. You will be informed of any extra charges relating to credit card use before they are incurred.

5. Medical Screening / Health Assessment Documents
Following successful payment of your Medical Screening / Program / Schedule, your HealthCare services provider will deliver documentation of the Result / Program / Schedule electronically.

An option to receive a copy of your Result / Program / Schedule via post may be offered by the HealthCare services provider at an extra cost.

In the event you do not receive your documentation, or you require a copy via post, please contact your HealthCare services provider directly quoting your registration number.

Upon receipt, it is important to check your documentation to make sure it covers all the information that you have provided and that all information is true and correct. You must report errors or mistakes to your HealthCare services provider before your program / schedule commences.

6. Amending or Cancelling Your Medical Screening
If you need to amend your Medical Screening, you will need to contact your HealthCare services provider directly. We cannot make changes to your result or documentation.

If you have a change in health or medication between the time you undergo Medical Screening and the time you start your Program / Schedule, you must inform your healthcare services provider, who may review the terms of your results. You could be in breach of Medical Screening’s terms and conditions if you fail to do so.

HealthyG1 Programs / Schedules have a 14 day right to cancel period. You are entitled to cancel your selected Program / Schedule provided you have not already started to undergo the treatments. You must contact your HealthCare services provider directly in order to cancel your Program / Schedule.

7. Vacation Camp - Informed Consent and Acknowledgement

You hereby give your approval for your child’s participation in any and all activities prepared by HealthyG1 during the selected camp. In exchange for the acceptance of the said child’s candidacy by  HealthyG1, you assume all risk and hazards incidental to the conduct of the activities, and release, absolve and hold harmless HealthyG1 and all its respective officers, agents, and representatives from any and all liability for injuries to said child arising out of traveling to, participating in, or returning from selected camp sessions.

In case of injury to said child, you hereby waive all claims against HealthyG1 including all coaches and affiliates, all participants, sponsoring agencies, advertisers, and, if applicable, owners and lessors of premises used to conduct the event. There is a risk of being injured that is inherent in all sports activities, including basketball. Some of these injuries include, but are not limited to, the risk of fractures, paralysis, or death.

8. Vacation Camp - Medical Release and Authorization

As Parent and/or Guardian of the above-mentioned child, you hereby authorize the diagnosis and treatment by a qualified and licensed medical professional, of the minor child, in the event of a medical emergency, which in the opinion of the attending medical professional, requires immediate attention to prevent further endangerment of the minor’s life, physical disfigurement, physical impairment, or other undue pain, suffering or discomfort, if delayed.

Permission is hereby granted to the attending physician to proceed with any medical or minor surgical treatment, x-ray examination and immunizations for the child. In the event of an emergency arising out of serious illness, the need for major surgery, or significant accidental injury, you understand that every attempt will be made by the attending physician to contact you in the most expeditious way possible. This authorization is granted only after a reasonable effort has been made to reach you.

Permission is also granted to HealthyG1 and its affiliates including Directors, Coaches, and Team Parents to provide the needed emergency treatment prior to the child’s admission to the medical facility.

Release authorized on the dates and/or duration of the registered season.

This release is authorized and executed of your own free will, with the sole purpose of authorizing medical treatment under emergency circumstances, for the protection of life and limb of the named minor child, in your absence.

9.  Making A Complaint
We realize that things can go wrong and there may be occasions when you feel that we have not provided the service you expected.

If you are unhappy with any product you have obtained from a HealthCare services provider or have any complaint regarding a HealthCare services provider, you should address your complaint directly to that HealthCare services provider. 10. Use of the Website

We reserve the right to change, modify, substitute, suspend or remove any material or content on the Website without notice, from time to time without there being any liability on our part. You further accept that such changes may result in your being unable to access the Website or part of it. We may have to suspend the Website from time to time to carry out maintenance and to make upgrades.

The Website is intended for your personal non-commercial use only. You agree to use the Website only for lawful purposes, and in a manner that does not infringe the rights or, restrict or inhibit the use of this Website by any third party.

By signing this Agreement and availing the Services, you hereby represent and warrant to HealthyG1 Ilera Afe LLP that you are 18 years of age or older, and that you have the right, authority and capacity to avail the Services, and agree to abide by the Agreement. If you are below 18 years of age, it is assumed that you are under the supervision of your parent or legal guardian and that your parent or legal guardian has read and agrees to the terms of this Agreement.

You agree to take reasonable precautions to ensure that any data you submit to the Website is true and accurate and free from viruses and anything else, which may have a contaminating or destructive effect on any part of the Website or any other technology.

You must ensure that all data you provide on the Website is correct, complete, accurate and not misleading and that you disclose all relevant facts.

You specifically undertake that you have disclosed all the facts and physical and mental conditions to the Practitioners of HealthyG1 and that nothing remains undisclosed regarding any medical condition.

You agree and understand that you will be solely responsible in the event of any concealed information, inaccuracy or deviation therefrom at a later stage.

You must get permission from any other person about whom you propose to provide information before you provide it. In submitting any other person’s details, you are confirming to us that you have their permission to do so and they understand how their details will be used.

HealthyG1 shall perform its services and give treatment as per its standard practices and availing such services does not guarantee curing of any illness, physical issues, mental issues, diseases etc. and you shall not hold HealthyG1 and/or any of its doctors or practitioners liable or responsible for any effects, side effects, damages, illnesses caused to you.
Any consideration paid by you in lieu of availing our services is non-refundable and you shall not be entitled to claim any refund in the event of termination of services by you, or in case of your unavailability or demise.
HealthyG1 shall endeavor to provide its best services to you and maintain the highest level of quality of medication towards you. However, we do not promise, guarantee or warranty resolving any of your health issues and you undertake to avail the services at your sole discretion.

15. Jurisdiction
The conditions of use will be governed by Indian law and the Courts of Mumbai district will have exclusive jurisdiction to intermediate on any dispute between us.

16. Keeping Your Information Safe
HealthyG1 takes your privacy very seriously. Your legal rights are protected, and we promise to do all we can to protect your privacy as set out in our Privacy Policy. Any personal information supplied by you via the Website is stored in keeping with Indian government regulations.

17. Exclusions of Liability
We use reasonable endeavors to ensure that the data on the Website is accurate and undertake to correct any errors or omissions. However, we do not guarantee that the Website will be fault free and we do not accept liability for any errors or omissions.

We do not accept any responsibility or liability for any loss damage you may suffer or incur if any information, content, material or data you provide on the Website is not correct, complete and accurate or if it is misleading or if you fail to disclose all relevant facts.

In no event shall HealthyG1 and/or its doctors, practitioners, affiliates and service providers be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of life of the patient caused due to any side effects. HealthyG1's liability in such cases would be restricted to assistance in speedy recovery and additional treatment for a term not exceeding 6 months from the date of expiry of the Terms of Services as aforementioned.
HealthyG1 provides no guarantee you in respect of the medication prescribed. HealthyG1 shall not be liable for any incidental or consequential damages that result from the administration of the prescribed medicine. Consequently, HealthyG1 assumes no liability whatsoever for any loss or other damage suffered by you on account of deviating from the treatment instructed by HealthyG1 or not following the instructions of the doctors and/or practitioners of HealthyG1.

18. Breach

Without limiting other remedies that HealthyG1, we may at our sole discretion take such action as we deem fit including but not limited to termination of services temporarily/indefinitely, and/or refuse to provide you services or initiate any legal action we may deem fit, particularly in the event of:

• You breaching any of the provisions of this Agreement including any of the rules and policies, documents, terms and conditions, payment policies made thereunder which are incorporated therein by reference;

• Any misuse of the prescriptions, medicines, certificates by HealthyG1;

• We believing that your actions may cause legal liability to HealthyG1;

• You not following the prescribed treatment and/or medication; 

No actions, omissions or decisions taken by HealthyG1 Ilera Afe LLP shall waive any rights or claims that HealthyG1 Ilera Afe LLP may have against the Patient.

19. Term & Termination

The Agreement will remain in full force and effect while you use any Service in any form or capacity.
HealthyG1 reserves the right to terminate its Services provided to you in the event of breach of any terms contained in the Agreement, misrepresentation of information, any unlawful activity or if HealthyG1 is unable to verify or authenticate any information you provide to it.
You may terminate the Agreement at any time, provided that you discontinue availing any further services, however, HealthyG1 shall not be entitled to give you any refund for the services not availed.
Any provision of the Agreement which imposes an obligation or creates a right that by its nature will be valid after termination or expiration of the Agreement shall survive the termination or expiration of the Agreement.
 

20. No Service List

HealthyG1 reserves the right to maintain and regularly update a “No Service List” which will essentially contain the names & other details of any individual and/or group of individuals and/or corporate or other entities currently or previously involved in any unresolved personal or legal dispute/s with HealthyG1 and/or any of its partners and/or affiliates and/or associates. HealthyG1 further reserves the “Right To Refuse”, to such parties, all services of HealthyG1 including but not limited to HealthCare, FarmStay, Therapeutic Healthy Food Menu, Panchakarma, Yoga and Meditation, and any other services that may be introduced from time to time. Any bookings made or any services booked by such parties and inadvertently accepted by HealthyG1 and/or any of its partners and/or affiliates and/or associates at any of its projects and/or outlets and/or entities will stand liable to be canceled and HealthyG1 shall be under no obligation to provide its services to such individuals and/or group of individuals and/or corporate or other entities appearing in “No Service List”. HealthyG1 will not stand responsible for any loss incurred and/or repercussions arising out of such cancellations and/or penal and/or legal actions, if any, initiated by HealthyG1.

21. Indemnity

You shall indemnify and hold harmless HealthyG1 and it's parent, subsidiaries, affiliates, third-parties and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of your breach of this Agreement including (a) the rules and policies incorporated herein by reference, or (b) your violation of any law, rules or regulations or the rights of a third party.

22. Force Majeure

If we are unable to perform our obligations to you (or able to perform them only at unreasonable cost) because of circumstances beyond our control, we may then cancel or suspend any of our obligations to you, without liability. Examples of those circumstances include act of God, accident, explosion, fire, transport delays, strikes and other industrial disputes.

23. Dispute Resolution and Governing Law

Any dispute arising out of any transaction is subject to Mumbai Jurisdiction & law. The Mumbai Courts shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with the services availed from HealthyG1 or any other issue that you may have with HealthyG1.
 

24. Waiver

HealthyG1’s failure to enforce any provision of the Agreement or respond to a breach by you shall in no way imply a waiver of HealthyG1’s right to subsequently enforce any provision of the terms of the Agreement or to act with respect to similar breaches by you.
 
25. Notices

All notices and communications shall be in writing, in English and shall be deemed given if delivered personally or by commercial messenger or courier service, or mailed by registered or certified mail (return receipt requested) or sent by email, with due acknowledgment or complete transmission to the following address:
